Appleyard Lees have successfully defended a medical bandaging patent for a global medical device company. After the European patent was granted, it was opposed by a competitor looking to clear the path in Europe. The opposition was refused at first instance. The decision was confirmed at an appeal hearing for all the main claims. The patent therefore remains in force blocking the path for competitor products in the EU.

Appleyard Lees advised a medical device manufacturer for over twenty years, supporting the company’s growth from a small start-up to PLC. Drafting, filing and prosecuting the first patent application to protect the original laparoscopic instrument upon which the company was founded, Appleyard Lees continued to advise on IP protection around the world as the company expanded its product portfolio. Patents were secured for various improvements and new products, and the company even secured licensing revenue from an engine manufacturer keen to use the technology in their field. However, the original patent provided market protection for twenty years and although now out of patent, that original patented technology is still at the heart of the company’s laparoscopic instrument range.
